1. Introduction
Welcome to Custom Packaging Plus ("Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website, products, and services (collectively, the "Services"). By accessing our website, placing an order, or using any of our Services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our Services. We reserve the right to modify these Terms at any time. Continued use of our Services following any changes constitutes acceptance of the revised Terms.
2. Eligibility
Our Services are available exclusively to individuals and entities that are at least 18 years of age and possess the legal capacity to enter into binding agreements. By using our Services, you represent and warrant that you meet these requirements.
If you are using our Services on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and that entity.
3. Products & Services
Custom Packaging Plus specializes in the design, manufacture, and supply of custom packaging solutions including but not limited to rigid boxes, corrugated mailers, folding cartons, kraft packaging, magnetic closure boxes, display packaging, and specialty packaging products.
All product images, descriptions, specifications, and samples are provided for illustrative purposes only. Actual products may vary in color, texture, finish, and dimensions within industry-standard tolerances. We reserve the right to modify, discontinue, or substitute any product at any time without prior notice.
3.1 Product Specifications
Due to the custom nature of our products and inherent variations in printing processes, materials, and substrates, the following industry-standard tolerances apply:
- Dimensional Tolerance: +/- 5% of ordered dimensions
- Color Accuracy: Within 90% of the approved digital proof
- Quantity Tolerance: +/- 5-10% of ordered quantity (overrun or underrun)
- Paper/GSM Tolerance: +/- 5% of specified paper weight
- Finish Variation: Matte, gloss, and spot UV finishes may vary between production runs
These tolerances are standard across the packaging industry and are not considered defects. Environmental conditions such as humidity, temperature, and storage may affect product dimensions and appearance over time.
4. Order Process
Our order process follows a structured workflow to ensure quality and accuracy:
- Inquiry & Consultation: You submit your packaging requirements through our website, email, or phone. Our team reviews your needs and provides a detailed quotation.
- Quotation & Proposal: We provide a written quotation including product specifications, pricing, estimated production time, and shipping details. Quotations are valid for 14 days from the date of issue unless otherwise specified.
- Design & Artwork: Upon order confirmation, our design team creates digital proofs for your review. You may request revisions within the scope of your order.
- Proof Approval: A final digital proof is provided for your approval. Production will not begin until written approval of the final proof is received.
- Production: Once the proof is approved, your order enters production. Production timelines vary by product type and order volume.
- Quality Check & Shipping: Completed orders undergo quality inspection before being dispatched to your specified delivery address.
5. Artwork & Design Requirements
5.1 File Specifications
To ensure optimal print quality, all artwork submitted for production must meet the following requirements:
- Color Mode: CMYK (Pantone/PMS colors must be specified in writing)
- Resolution: Minimum 300 DPI at actual print size
- Accepted Formats: PDF (preferred), AI, EPS, PSD, PNG, TIFF
- Fonts: All fonts must be outlined or embedded
- Bleed: Minimum 3mm bleed on all sides
- Images: All images must be embedded, not linked
Files submitted below these specifications may result in reduced print quality. We are not responsible for poor print results caused by substandard artwork files provided by the customer.
5.2 Proof Approval
Digital proofs will be provided for your review before production begins. It is your sole responsibility to carefully review all proofs for errors including but not limited to spelling, grammar, color accuracy, dimensions, design placement, and overall layout.
Once you approve the proof, Custom Packaging Plus is not responsible for any errors that were present in the approved proof. Changes or corrections cannot be made after production has commenced.
If you require a physical (hard) proof before committing to full production, this can be arranged at an additional cost. Hard proof timelines and pricing will be communicated upon request.
5.3 Color Disclaimer
Due to inherent differences in digital screen displays, printing processes, ink formulations, and substrate materials, minor color variations between digital proofs and final printed products are normal and expected. The accuracy of color reproductions is guaranteed to be within 90% of the approved digital proof. This is an industry-standard tolerance and is not considered a defect.
We strongly recommend ordering a physical sample or hard proof if precise color matching is critical to your project.
6. Intellectual Property
6.1 Company Intellectual Property
All content on our website, including but not limited to text, graphics, logos, product names, images, designs, templates, dielines, and software, is the property of Custom Packaging Plus or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.
6.2 Customer Intellectual Property
You retain ownership of all artwork, logos, images, designs, trademarks, and content you submit to us for use in your packaging. By submitting such materials, you grant Custom Packaging Plus a limited, non-exclusive license to use, reproduce, and display your materials solely for the purpose of fulfilling your order.
6.3 Tooling & Die Ownership
Cutting dies, plates, screens, printing blocks, and any other tooling or equipment created or used for your order remain the property of Custom Packaging Plus unless otherwise agreed in writing. Storage of tooling is subject to our capacity and retention policies. Customers who wish to retain exclusive tooling for future use may arrange dedicated storage under a separate agreement with applicable charges.
6.4 Design Ownership
Structural designs, dielines, and creative artwork developed by Custom Packaging Plus remain our intellectual property until full payment is received. Upon full payment, ownership of the final approved design transfers to the customer. Pre-production concepts, drafts, and rejected designs remain our property.
7. Payment Terms
7.1 Pricing
All prices quoted are estimates and are subject to change without prior notice. Unless otherwise specified, all prices are in US Dollars (USD) and are exclusive of applicable taxes, duties, and shipping charges. Quoted prices are valid for 14 days from the date of the quotation.
7.2 Payment Methods
We accept the following payment methods:
- Credit/Debit Cards (Visa, MasterCard, American Express)
- Bank Wire Transfer / ACH Transfer
- PayPal
- Check (for established accounts only)
7.3 Payment Schedule
- New Customers: 100% payment required upfront before production begins.
- Established Customers: 50% deposit upon order confirmation, remaining 50% due before shipment.
- Credit Accounts: Net 30 terms available for qualifying businesses upon credit approval.
7.4 Late Payments
Invoices not paid when due shall accrue a delinquency charge of 1.5% per month (or the maximum rate permitted by law, whichever is lower) on the outstanding balance. We reserve the right to suspend or cancel any pending orders if payment is overdue.
7.5 Taxes
You are responsible for all applicable sales taxes, value-added taxes (VAT), goods and services taxes (GST), customs duties, and any other governmental charges associated with your order. Tax exemption certificates must be provided at the time of order placement.
8. Order Cancellation
Orders may be cancelled subject to the following cancellation schedule:
- Before design work begins: Full refund minus any administrative fees (up to 10%).
- After design work begins but before proof approval: 20% cancellation fee applies to cover design and administrative costs.
- Within 24 hours of proof approval: 50% cancellation fee applies.
- After 24 hours of proof approval: Order cannot be cancelled. Full payment is non-refundable.
- After production has commenced: Order cannot be cancelled under any circumstances.
- After shipment: Order cannot be cancelled. Standard return policies apply.
Cancellation requests must be submitted in writing via email. Verbal cancellation requests will not be accepted.
9. Shipping & Delivery
9.1 Delivery Timelines
Estimated delivery timelines are provided at the time of order confirmation and vary by product type, order volume, and destination:
- Corrugated & Mailer Boxes: 10-15 business days after proof approval
- Rigid & Luxury Boxes: 14-21 business days after proof approval
- Kraft & Eco-Friendly Packaging: 10-15 business days after proof approval
- Rush Orders: 7-10 business days (subject to 15-25% rush surcharge)
All delivery timelines are estimates and are not guaranteed. Delays may occur due to high order volumes, material shortages, or unforeseen circumstances. We will notify you promptly of any significant delays.
9.2 Risk of Loss
Risk of loss and damage to products transfers to you upon delivery to the designated carrier at our facility. Title to the products passes to you upon receipt of full payment.
9.3 Shipping Liability
Custom Packaging Plus shall not be liable for lost, stolen, or damaged packages once handed to the carrier. However, we will provide reasonable assistance in filing claims with the applicable carrier upon your request. Claims for damaged or lost shipments must be reported within 7 business days of the expected delivery date.
9.4 International Orders
For international shipments, you are solely responsible for all customs duties, import taxes, brokerage fees, and any other charges imposed by your country's customs authorities. We are not responsible for delays caused by customs clearance processes. Delivery timelines for international orders may be extended beyond standard estimates.
9.5 Address Errors
It is your responsibility to provide accurate and complete shipping information. Orders shipped to incorrect or incomplete addresses may incur additional re-shipping charges. We are not responsible for delivery delays or failures resulting from incorrect address information provided by the customer.
10. Returns & Refunds

10.1 General Policy
Due to the custom-manufactured nature of our products, all sales are final once production has begun. We do not accept returns or provide refunds for custom products unless the items are defective or do not conform to the approved specifications.
10.2 Defect Claims
If you believe your order contains defective products or products that do not match the approved specifications, you must notify us within 7 business days of receiving your order. Claims must include:
- Your order number and date of purchase
- Clear photographs and/or video of the defect
- A written description of the issue
- Quantity of affected items
We reserve the right to request the return of defective items for inspection. Returns must include at least 99% of the original order quantity and must be in their original, unused condition.
10.3 Remedies
For valid defect claims, our liability is limited to, at our sole discretion:
- A full or partial reprint of the defective items
- A credit toward your next order
- A refund of the purchase price for the defective items
We do not provide refunds for customer errors, change of mind, or aesthetic preferences that differ from the approved proof.
11. Indemnification
You agree to indemnify, defend, and hold harmless Custom Packaging Plus, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of our Services
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any intellectual property infringement claims arising from artwork, designs, logos, or content you submit for printing
- Any dispute between you and a third party
12. Limitation of Liability
To the maximum extent permitted by applicable law, Custom Packaging Plus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services or products, including but not limited to:
- Loss of profits, revenue, or business opportunities
- Loss of data or goodwill
- Brand or reputational damage
- Business interruption
- Missed product launch dates or retail deadlines
- Cost of procuring substitute products or services
Our total aggregate liability for any and all claims arising out of or related to these Terms, our Services, or our products shall not exceed the total amount paid by you for the specific order giving rise to the claim.
13. Force Majeure
Custom Packaging Plus shall not be liable for any delay or failure to perform its obligations under these Terms resulting from causes beyond its reasonable control, including but not limited to:
- Natural disasters, earthquakes, floods, hurricanes, or extreme weather
- Pandemics, epidemics, or public health emergencies
- Fire, explosion, or structural damage to facilities
- War, terrorism, civil unrest, or political instability
- Government actions, regulations, sanctions, or trade embargoes
- Supply chain disruptions, material shortages, or raw material price volatility
- Labor disputes, strikes, or workforce shortages
- Failures of third-party suppliers, carriers, or service providers
- Port closures, shipping route disruptions, or transportation delays
- Power outages, telecommunications failures, or cyberattacks
- Geopolitical tensions or trade restrictions
In the event of a force majeure occurrence, we will notify you as soon as reasonably practicable and use commercially reasonable efforts to mitigate the impact and resume performance as quickly as possible.
14. Privacy & Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using our Services, you consent to the collection and use of your information as described in our Privacy Policy. We implement industry-standard security measures to protect your personal data, including encryption, secure servers, and access controls.
15. Governing Law & Dispute Resolution
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Custom Packaging Plus is registered, without regard to its conflict of law principles.
15.2 Informal Resolution
Before initiating any formal dispute resolution proceedings, you agree to first contact us and attempt to resolve the dispute informally. Most concerns can be resolved quickly and amicably through direct communication. We encourage you to reach out to our customer support team to discuss any issues.
15.3 Binding Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms or our Services shall be resolved through binding arbitration administered in accordance with applicable arbitration rules. The arbitration shall take place in the jurisdiction where Custom Packaging Plus is registered.
15.4 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Custom Packaging Plus.
15.5 Limitation Period
Any claim arising out of or related to these Terms or our Services must be filed within one (1) year after the cause of action accrues, or such claim is permanently barred.
16. Termination
We reserve the right to suspend or terminate your access to our Services at our sole discretion, without prior notice, if you violate these Terms, engage in fraudulent or unlawful activity, or for any other reason we deem necessary to protect our business interests or the safety of our customers.
Upon termination, all outstanding payments become immediately due. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property, indemnification, limitation of liability, and governing law provisions.
17. Modifications to Terms
We reserve the right to modify these Terms at any time at our sole discretion. Changes will be effective immediately upon posting on our website. The "Last Updated" date at the top of this page indicates when these Terms were last revised.
It is your responsibility to review these Terms periodically. Your continued use of our Services after any modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using our Services immediately.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
19. Entire Agreement
These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Custom Packaging Plus regarding the use of our Services. These Terms supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to the subject matter herein.
20. Waiver
No failure or delay by Custom Packaging Plus in exercising any right, power, or privilege under these Terms shall operate as a waiver of that right, power, or privilege. No single or partial exercise of any right, power, or privilege shall preclude any other or further exercise thereof.
